Privacy Policy Foreword We, Jobortunity.ai UG (limited liability) (hereinafter: "the company," "we," or "us"), take the protection of your personal data seriously and would like to inform you about data protection in our company. Within the scope of our data protection responsibilities, the entry into force of the EU General Data Protection Regulation (Regulation (EU) 2016/679; hereinafter: "GDPR") has imposed additional obligations on us to ensure the protection of personal data of the data subject (we also refer to you as the data subject as "customer," "user," "you," or "data subject"). It consists of a general section for all processing of personal data and processing situations that apply each time a website is accessed (Section A. This includes, in particular, the collection (i.e., procurement), recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning, combining, restricting, erasing or destroying personal data, as well as changing the purpose or objective for which the data was originally processed. - "Controller" (Art. 4 No. 7 GDPR) is the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. - "Third party" (Art. 4 No. 10 GDPR) is any natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or processor, are authorized to process personal data; this also includes other legal entities belonging to the group. - "Processor" (Art. 4 No. 8 GDPR) is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller, in particular in accordance with its instructions (e.g. IT service providers). In terms of data protection law, a processor is not a third party. - "Consent" (Art. 4 No. 11 GDPR) of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her. (3) Legal basis for data processing By law, any processing of personal data is prohibited in principle and is only permitted if the data processing falls under one of the following justifications: - Art. 6 (1) (a) GDPR ("Consent"): If the data subject has voluntarily, in an informed manner and unambiguously indicated by a statement or other unequivocal affirmative action that he or she consents to the processing of personal data relating to him or her for one or more specific purposes; - Art. 6 (1) (b) GDPR: If processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; - Art. 6 (1) (c) GDPR: If processing is necessary for compliance with a legal obligation to which the controller is subject (e.g., a statutory retention obligation); - Art. 6 (1) (d) GDPR: If processing is necessary to protect the vital interests of the data subject or another natural person; - Art. 6 (1) (e) GDPR: If processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; or - Art. 6 (1) (f) GDPR ("legitimate interests"): If processing is necessary for the purposes of the legitimate (in particular legal or economic) interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject (in particular where the data subject is a child). We indicate the applicable legal basis for each of the processing operations we carry out below. Processing may also be based on several legal bases. (4) Data deletion and storage period For the processing operations we carry out, we specify below how long the data is stored by us and when it is deleted or blocked. Unless an explicit storage period is specified below, your personal data will be deleted or blocked as soon as the purpose or legal basis for storage no longer applies. Your data will only be stored on our servers in Germany, subject to any transfer in accordance with the provisions in A.(6) and A.(7).However, storage may continue beyond the specified period in the event of an (imminent) legal dispute with you or other legal proceedings, or if storage is required by legal regulations to which we are subject as the controller (e.g., Section 257 of the German Commercial Code (HGB), Section 147 of the German Fiscal Code (AO)). When the storage period prescribed by law expires, the personal data will be blocked or deleted, unless further storage by us is necessary and there is a legal basis for this. (5) Data security We use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties (e.g., TLS encryption for our website), taking into account the state of the art, implementation costs, and the nature, scope, context, and purpose of the processing, as well as the existing risks of a data breach (including its likelihood and impact) for the data subject. Our security measures are continuously improved in line with technological developments. We will be happy to provide you with further information on request. (6) Cooperation with processors If we use external service providers (e.g., for IT, logistics, telecommunications, sales, and marketing) to conduct our business, they will only act on our instructions and will be contractually obliged to comply with data protection regulations in accordance with
Art. 28 GDPR. (7) Requirements for the transfer of personal data to third countries Within the scope of our business relationships, your personal data may be transferred or disclosed to third-party companies. These may also be located outside the European Economic Area (EEA), i.e., in third countries. Such processing is carried out exclusively for the purpose of fulfilling contractual and business obligations and maintaining your business relationship with us. We will inform you of the respective details of the transfer in the relevant sections below. The European Commission certifies that some third countries have data protection standards comparable to those of the EEA through so-called adequacy decisions (a list of these countries and a copy of the adequacy decisions can be found here: https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data- protection/adequacy-decisions_en). In other third countries to which personal data may be transferred, however, there may not be a consistently high level of data protection due to a lack of legal provisions. Where this is the case, we ensure that data protection is adequately guaranteed. This can be achieved through binding corporate rules, standard contractual clauses of the European Commission for the protection of personal data, certificates, or recognized codes of conduct. (8) No automated decision-making (including profiling) We do not intend to use personal data collected from you for automated decision-making (including profiling). (9) Legal obligation to transfer certain data We may be subject to a specific legal or regulatory obligation to provide lawfully processed personal data to third parties, in particular public authorities (Art. 6 (1) (c) GDPR). § 3 Registration and use of platform functions requiring registration On our platform, we offer users the opportunity to register by providing personal data. The data is entered into an input mask, transmitted to us, and stored. The data is not passed on to third parties. § 4 Hosting and backend services (1) Website hosting We use Vercel Inc. as our hosting and deployment platform for operating our website. The data you upload is processed and stored by Cloudinary on AWS (Amazon Web Services) servers, which may be located anywhere in the world, including the USA. § 6 Technical and organizational measures For security reasons and to protect the transmission of personal data and other confidential content (e.g., inquiries via contact forms, login data, uploaded documents), our website uses SSL or TLS encryption (Secure Sockets Layer / Transport Layer Security). You can recognize an encrypted connection by the fact that the address line of your browser displays the prefix "https://" instead of "http://" and by the lock symbol in the address line of your browser. Data transmission between us and the service providers we use is also encrypted. Our TLS encryption is based on digital certificates issued by trusted certification authorities. These certificates confirm the identity of our website and enable encrypted communication. Your browser automatically checks the validity of the certificate each time you visit the site. If the certificate is invalid or has expired, you will receive a security warning from your browser. In such a case, you should not transmit any personal data and should inform us using the contact details in the legal notice.
